Dear family in Christ,

We write today to make you aware of five recent Title IV matters involving three bishops who have been nominated for election as our next presiding bishop. We recognize the gravity of this decision, and we would like to explain our reasons for this disclosure.

Over the past year, many bishops, other clergy, and laypeople have called for greater transparency in our processes that address bishop misconduct. As followers of Jesus of Nazareth, we know that the call to lead comes with an extra measure of accountability, and we believe that balancing appropriate confidentiality with appropriate transparency will help increase trust that our church is a safe place for all of God’s children.

While our canons do not require the kind of disclosure we are making today, they do leave room for the presiding bishop or presiding bishop-designate to exercise discretion in Title IV matters when sharing information is pastorally appropriate.

In this instance, we believe disclosure is pastorally appropriate because the subjects of the complaints are people who have been nominated as our next presiding bishop, and this disclosure protects the integrity of the presiding bishop election.

We provide this information with the caution that our canons make it clear that all persons against whom allegations are made are presumed innocent until proven otherwise.

Two Title IV matters are currently pending against bishops who are nominees for presiding bishop. The nature of the allegations and the procedural status of those matters are as follows, with bishops named alphabetically:

• The Rt. Rev. DeDe Duncan-Probe: On May 5, 2024, the intake officer for bishops received an anonymous report that Bishop Duncan-Probe had publicly misrepresented her academic credentials. The reference panel referred the matter for investigation on May 22, 2024.
• The Rt. Rev. Daniel Gutiérrez: On June 5, 2024, the intake officer for bishops received a report criticizing Bishop Gutiérrez’s handling of a Title IV matter involving allegations of sexual misconduct against a priest in the diocese. The reference panel referred the matter for investigation on June 11, 2024.

Three Title IV matters involving nominees for presiding bishop have been considered in the Title IV process and have been dismissed:

• The Rt. Rev. DeDe Duncan-Probe: On Dec. 20, 2023, the intake officer for bishops received a report criticizing Bishop Duncan-Probe for refusing to permit the complainant to continue in the discernment process and requiring the complainant to refer future correspondence to the chancellor. The intake officer dismissed the matter on Feb. 20, 2024, and, after an appeal by the complainant, the dismissal was upheld by the president of the Disciplinary Board for Bishops on March 21, 2024.

• The Rt. Rev. Daniel Gutiérrez: On May 15, 2024, the intake officer for bishops received an anonymous report criticizing Bishop Gutiérrez for resolving a Title IV matter involving a priest in the diocese with an accord the complainant regarded as too harsh and for allegedly failing to provide adequate pastoral support to the parish. The reference panel decided on May 28, 2024, to take no action other than appropriate pastoral response, and the matter was dismissed.

• The Rt. Rev. Robert Wright: On Dec. 15, 2023, the intake officer for bishops received allegations of ageism, ableism, microaggressions, and abuse of power by Bishop Wright. The reference panel decided on Feb. 22, 2024, to take no action other than appropriate pastoral response, and the matter was dismissed.

We hope you receive this information in the spirit of our intent, and we call all Episcopalians to prayer in this season of discernment about the future of our beloved church.

Les escribimos hoy para informarles sobre cinco asuntos recientes del Título IV que implican a tres obispos que han sido nominados como candidatos en la elección de nuestro próximo Obispo Primado. Reconocemos la gravedad de esta decisión y nos gustaría explicar los motivos de esta divulgación.

A lo largo del pasado año, muchos obispos, así como otros clérigos y laicos han pedido una mayor transparencia en nuestros procesos que abordan la conducta impropia de los obispos. Como seguidores de Jesús de Nazaret, sabemos que el llamado a liderar viene con una medida adicional de responsabilidad, y creemos que equilibrar la debida confidencialidad con la debida transparencia ayudará a aumentar la confianza en que nuestra Iglesia es un lugar seguro para todos los hijos de Dios.

Si bien nuestros cánones no requieren el tipo de divulgación que estamos haciendo hoy, sí dejan espacio para que el Obispo Primado o el[la] Obispo Primado designado ejerza discreción en asuntos relacionados con el Título IV respecto a cuando compartir información resulta pastoralmente apropiado.

En este caso, creemos que la divulgación es pastoralmente apropiada porque los sujetos de las denuncias son personas que han sido nominadas como candidatos a ser nuestro próximo Obispo Primado, y esta divulgación protege la integridad de la elección del[de la] Obispo Primado.

Proporcionamos esta información con la precaución de que nuestros cánones dejan claro que todas las personas contra quienes se hacen acusaciones se presumen inocentes hasta que se demuestre lo contrario.

Actualmente hay dos asuntos pendientes del Título IV contra obispos nominados a Obispo Primado. La naturaleza de las acusaciones y el estado procesal de esos asuntos son los siguientes, con los obispos nombrados en orden alfabético:

• Rvdma. DeDe Duncan-Probe: El 5 de mayo de 2024, el gestor de la causa de obispos recibió un informe anónimo de que la obispa Duncan-Probe había falsificado públicamente sus credenciales académicas. El panel de referencia remitió el asunto para investigación el 22 de mayo de 2024.
• Rvdmo. Daniel Gutiérrez: El 5 de junio de 2024, el gestor de la causa de obispos recibió un informe en que se criticaba el manejo por parte del obispo Gutiérrez de un asunto relacionado con el Título IV que implicaba acusaciones de conducta sexual impropia contra un sacerdote de la diócesis. El panel de referencia remitió el asunto para investigación el 11 de junio de 2024.

Tres asuntos relativos al Título IV que implican a candidatos a Obispo Primado han sido considerados en el proceso del Título IV y han sido desestimados:

• Rvdma. DeDe Duncan-Probe: El 20 de diciembre de 2023, el gestor de la causa de obispos recibió un informe criticando a la obispa Duncan-Probe por negarse a permitir que el demandante continuara en el proceso de discernimiento y exigirle que remitiera su futura correspondencia al canciller. El gestor de causas de obispos desestimó el asunto el 20 de febrero de 2024 y, tras una apelación del demandante, la desestimación fue confirmada por el presidente de la Junta Disciplinaria para Obispos el 21 de marzo de 2024.
• Rvdmo. Daniel Gutiérrez: El 15 de mayo de 2024, el gestor de la causa de obispos recibió un informe anónimo criticando al obispo Gutiérrez por resolver un asunto del Título IV que involucraba a un sacerdote de la diócesis con un acuerdo que el demandante consideraba demasiado estricto y por supuestamente no proporcionar apoyo pastoral adecuado a la parroquia. El panel de referencia decidió el 28 de mayo de 2024 no tomar ninguna medida más que la respuesta pastoral apropiada, y el asunto fue desestimado.
• Rvdmo. Robert Wright: El 15 de diciembre de 2023, el gestor de la causa de obispos recibió acusaciones de discriminación por edad, capacitismo, microagresiones y abuso de poder por parte del obispo Wright. El panel de referencia decidió el 22 de febrero de 2024 no tomar ninguna medida más que la respuesta pastoral apropiada, y el asunto fue desestimado.
